Purpose

The bill aims to prevent government entities in Minnesota from working with the federal government to enforce civil immigration laws. It would prohibit entering into any immigration enforcement agreement and require the immediate termination of any existing agreements after the bill becomes law.

Definitions

• Immigration enforcement agreement: any contract, agreement, intergovernmental service agreement, or memorandum of understanding with the federal government that authorizes a state, a unit of local government, a county sheriff, or any state/local agency officer, employee, or agent to enforce civil immigration law.
• This includes agreements made under federal law, specifically references to United States Code titles 8, sections 1103 and 1357, or any other federal law.

Prohibition

• The state, any unit of local government, a county sheriff, or any state/local agency officer, employee, or agent may not enter into an immigration enforcement agreement.

Termination of Existing Agreements

• Any existing immigration enforcement agreement must be terminated the day after final enactment of this section.

Significant Changes to Existing Law

• Creates a new prohibition within Minnesota law (Minnesota Statutes chapter 626, section 626.893) that forbids collaboration with federal immigration enforcement efforts.
• Requires immediate termination of current agreements, eliminating ongoing arrangements that authorize state or local entities to enforce civil immigration law on behalf of the federal government.
