Purpose

• This act proposes a capital investment appropriation to fund improvements to the City of Albert Lea’s wastewater treatment facility. It authorizes the sale and issuance of state bonds to cover the project costs.

Main Provisions

• Subdivision 1 – Appropriation
  • An amount of 25,000,000 from the bond proceeds fund is appropriated to the Public Facilities Authority (PFA) as a grant to the city of Albert Lea.
  • The grant is for design, demolition, construction, and equipment improvements to upgrade the city’s wastewater treatment facility.
  • The appropriation covers design, renovation, repairs, and replacement of infrastructure equipment and other components of the facility’s wastewater treatment systems, including site improvements to buildings and other structures, and costs of demolition related to the project.
  • The money is available for the project only after the commissioner of management and budget determines that sufficient resources have been committed to complete the project as required by Minnesota Statutes section 16A.502.
• Subdivision 2 – Bond Sale
  • The commissioner of management and budget must sell and issue bonds of the state in an amount up to 25,000,000 to fund the appropriation.
  • Bonds are to be issued in the manner and with the terms prescribed by Minnesota Statutes sections 16A.631 to 16A.675 and by the Minnesota Constitution article XI sections 4 to 7.

Availability and Oversight

• The appropriation becomes available only once the budget commissioner verifies that adequate resources are committed to finish the project, per Minn. Stat. 16A.502.
• The funding and bonds follow statutory provisions governing bond sales (16A.631–16A.675) and the state constitution.
