Purpose

• Update how the MNsure board works with state agencies to manage costs and services for public health care programs that use a modified adjusted gross income (MAGI) standard for eligibility.
• Clarify and expand the kinds of agreements the MNsure board may establish with other state agencies (and with Indian tribes) to support MNsure operations, including enforcement of MNsure certification requirements for health and dental plans.

Main provisions

• Cost allocation and eligibility work with DHS:
  • The MNsure board must establish and maintain an agreement with the commissioner of human services for cost allocation and services related to eligibility determinations and enrollment for public health care programs that use MAGI to determine eligibility.
• Other services with DHS:
  • The MNsure board may establish and maintain an agreement with the commissioner of human services for other services beyond eligibility determinations and enrollment.
• Enforcement and plan certification with Commerce and Health:
  • The MNsure board may establish and maintain agreements with the commissioners of commerce and health for services related to enforcing MNsure certification requirements for health plans and dental plans offered through MNsure.
  • The board may establish and maintain agreements with the commissioners of commerce and health for other services as well.
• Interagency fund transfers:
  • The board may establish interagency agreements to transfer funds to other state agencies for their costs related to implementing and operating MNsure, excluding medical assistance allocable costs.
• Consultation requirements:
  • The board must consult with the commissioners of commerce and health about the operations of MNsure.
  • The board must consult with Indian tribes and organizations regarding the operation of MNsure.
• Reporting to the Legislature:
  • Beginning March 15, 2016 and every March 15 thereafter, the board must report to the chairs and ranking minority members of the Senate and House committees with primary jurisdiction over commerce, health, and human services on all MNsure-related agreements entered into with the chief information officer of the Department of Information Technology Services or with the commissioners of human services, health, or commerce under this subdivision.
  • The report must include: the agency involved, the term of the agreement, the purpose, and a summary of the terms.
  • A copy of the agreement should be provided to the extent practicable.

Significant changes to existing law

• Expands the MNsure board’s authority to enter into interagency and cross-agency agreements (with the commissioners of human services, commerce, health, and the Chief Information Officer of IT Services) to support MNsure operations.
• Changes and codifies ongoing reporting requirements to legislative leadership about these agreements, including specifics about the agreements and terms.
• Reinforces ongoing collaboration with DHS, Commerce, Health, IT Services, and with Indian tribes and organizations to operate MNsure.
