Purpose

• The bill aims to expand the list of people who are ineligible for earned incentive release credit under the Minnesota Rehabilitation and Reintegration Act.

Main provisions

• It amends Minnesota Statutes 2024 section 244.45 to specify who cannot receive earned incentive release credit.
• Adds the following ineligible categories:
  • Those serving life sentences.
  • Those given indeterminate sentences for crimes committed on or before April 30, 1980.
  • Those subject to good time under section 244.04 or similar laws.
  • Those serving sentences for labor trafficking under section 609.282.
  • Those involved in unlawful conduct with respect to documents in furtherance of labor or sex trafficking under section 609.283.
  • Prostitution or sex trafficking offenses under section 609.322 (first through fifth degree).
  • Criminal sexual conduct under sections 609.342 to 609.345.
  • Criminal sexual predatory conduct under section 609.3453.
  • Sexual extortion under section 609.3458.
• The changes apply to the earned incentive release credit program and specify these individuals are not eligible for that credit.
