   • Cannabis flower in the adult-use market: total THC must not exceed 15% by weight.
   • Cannabis concentrate (liquid or solid) in the adult-use market: total THC must not exceed 30% by weight.
   • Topical or transdermal cannabis products and topical or transdermal hemp products: must not contain more than 500 milligrams of total THC per package.
   • Total THC is defined as the sum of the percentage by weight of tetrahydrocannabinolic acid (THCA) times 0.877 plus the percentage by weight of all tetrahydrocannabinols.

5. Product restrictions and prohibitions

   • The Office must not approve certain cannabis products for sale in the adult-use market, including:
   • Cannabis flower or prerolls infused with additional THC or other psychoactive cannabinoids.
   • Lower-potency hemp edibles or hemp-derived products that look like or are marketed to appeal to children (e.g., lollipops, ice cream, pastries, candy, chocolate confections, or products bearing likenesses of real or fictional people, animals, or fruits).
   • Products that resemble meat or dairy products, or that use synthetic cannabinoids, or contain non-FDA-approved ingredients in foods.
   • Any product that is modeled after a brand or type predominantly consumed by or marketed to children.

6. Product categories and authority

   • The Office shall approve product categories for retail sale (cannabis flower, cannabis products, lower-potency hemp edibles, hemp-derived consumer products) and may enforce limits on total THC per package.
   • Definitions and handling of product units (SKU/UPC) will not prevent a product from being considered the same type as another unit.

7. Labeling, testing, and information requirements

   • For all cannabis flower and hemp-derived products sold to customers or patients, labels must include:
   • The name and license number of the cultivating or growing business and the producing or manufacturing business.
   • Net weight, batch number, and cannabinoid profile.
   • A universal symbol indicating the package contains cannabis or hemp product.
   • Verification that the product was tested and complies with applicable standards.
   • Information on how to use the product.
   • A set of required warnings (see below under Warnings and consumer information).
   • For all cannabis products (including lower-potency hemp edibles and hemp-derived products), labels must include:
   • The name and license number of the business that cultivated the plant parts and the business that manufactured the product.
   • Net weight, product type, batch number, serving size, and cannabinoid profile per serving and total.
   • Ingredients list and a universal symbol.
   • A warning symbol designed by the Office (size and visibility requirements) and the required warning statements.
   • Verification of testing and compliance with standards and the usage information.

8. Warning statements and consumer safety

   • The labeling must include warnings such as:
   • Keep out of reach of children and that cannabis products can be life-threatening to children, especially younger than five.
   • Using cannabis before age 25 can harm brain development and affect attention, concentration, and memory.
   • Using cannabis before age 25 can increase risk of mental disorders like psychosis and schizophrenia; more frequent use increases the risk.
   • Daily or near-daily use can lead to dependence or addiction; higher THC doses increase the risk; dependence can raise anxiety and depression.
   • Do not use cannabis if pregnant or breastfeeding; it can harm fetal or child development.
   • Do not drive under the influence of cannabis.
   • A warning symbol must be at least a specified size, in a highly visible color, and include a visual element indicating stop, plus the Minnesota Poison Control System phone number.

9. Notices at retail locations

   • Cannabis businesses must post notices at each retail location, including:
   • Information about any product recall.
   • A statement that operating a motor vehicle under the influence of intoxicating cannabinoids is illegal.
   • A statement that cannabis products and hemp products are for individuals at least 21 years old.

10. Imported lower-potency hemp edibles

    • The Office may allow alternative labeling for imported lower-potency hemp edibles if those labeling requirements provide substantially similar consumer information.

11. Definitions added or clarified

    • Preroll: a product containing cannabis or hemp that is manufactured as a smokable unit ready-made for ignition.
    • Substance use disorder: defined as the meaning in section 245F.02 subdivision 24.

12. Testing and standards

    • All cannabis and hemp products must be tested according to section 342.61 and comply with the applicable standards.
